Arqule, Daiichi's colorectal cancer drug fails trial

(Reuters) - An experimental colorectal cancer drug being developed by ArQule Inc and Japan's Daiichi Sankyo Co Ltd failed to improve patient survival without the cancer worsening, in a mid-stage trial, sending ArQule's shares down 18 percent.

ArQule shares were down 15 percent at $2.48 on the Nasdaq on Friday morning. They touched a low of $2.39 earlier in the session.

The trial, which enrolled 122 patients with refractory or relapsed colorectal cancer, also failed to meet the secondary goal of showing improved response to the drug tivantinib.

RBC Capital Markets analyst Adnan Butt said the stock fall was an "overreaction," as Wall Street's financial models did not include the drug's use in colorectal cancer.

"We attribute the majority of ArQule's value to the second-line liver cancer indication at this stage," Butt wrote in a note.

The drug tivantinib, ArQule's lead candidate, is also being developed as a potential treatment for hepatocellular carcinoma or liver cancer.

ArQule and Daiichi in October said they reached an agreement with the U.S. regulator on the design of a late-stage trial of tivantinib in liver cancer.

Friday's trial failure is the latest in a series of drug-related bad news for the company in the past few months. It discontinued a lung cancer trial in October and its Asian partner Kyowa Hakko Kirin Co halted another trial in August due to safety issues.

Both the trials were related to tivantinib.

The string of trial failures have dragged the company's shares, which have lost nearly 53 percent of their value over the past six months.

MID-STAGE TRIAL FAILS

For the latest mid-stage trial, patients were either given the drug, tivantinib, twice daily, in combination with older cancer drugs irinotecan and cetuximab, or placebo plus irinotecan and cetuximab.

The drug improved patients' progression-free survival (PFS), or survival without the cancer growing, but the improvement was not statistically significant.

PFS was 8.3 months for patients treated with the drug, compared with 7.3 months for those receiving a placebo.

ArQule tied up with Daiichi Sankyo in December 2008 to co-develop tivantinib in the United States, Europe, South America and other regions.

The companies plan to continue discussions with colorectal cancer experts to determine how to proceed with further development of the drug for this cancer, Daiichi said.

If you thought Pilar Sanders was getting the short end of the stick during her divorce from football/baseball legend Deion Sanders, it turns out the NFL?broadcaster is having his own issues as well.? Find out why his legal team is walking away from him inside....

We told you about previously about Pilar Sanders coming out on the losing end of her ongoing divorce from Deion Sanders, but things just got even messier as the legal team that had previously won so many victories for Deion, is now ALSO divorcing him.

In legal documents filed on New Year's Eve, Deion's legal team effectively quit the divorce proceedings and asked to be withdrawn from the case, stating an inability to ?effectively communicate with their client.?? They noted that Deion is ?unable to pay his attorneys pursuant to the terms of the employment agreements with his attorneys.?

It's interesting to see how this will play out since Deion and Pilar were due back in court on?January 9 to resolve their custody dispute.? SMH....

?Nothing surprises me at this point, first he screws Pilar out of her support, now his legal counsel, what?s next? I look at it this way all Deion had to do was write a check and do right by the mother of his children. That?s what this all comes down to, a dollar, a simple dollar. Deion has been very blessed throughout his career and to have made the income he has, why would he not want his children to continue on with a similar lifestyle? Spite ? that?s all it is spite, hate and resentment. Sadly, a new year has no resolution in anytime soon. I would ask to have the madness to stop, the lies (which are now leading to libel law suits), he [Deion] promises small time ?blogs? exclusives and to put them in touch with other sports figures & celebrities in exchange to attempt to make her look bad, writing nasty lies. At the end these bloggers will realize they got screwed as well as ending up in a court room themselves.?

Well...maybe this shakeup in Deion's camp will give Pilar the opportunity to get her foot back in the game and win her kids back.? We will keep you posted.....

Actor Josh Brolin, who plays a police sergeant in the upcoming Hollywood movie "Gangster Squad," was arrested Wednesday after police found him heavily intoxicated and unable to care for himself on a Santa Monica sidewalk, police said on Saturday.

Brolin was contacted by police in the 1600 block of Ocean Avenue around 11:30 p.m. Tuesday, said Santa Monica Police Sgt. Richard Lewis.?He was booked into custody at 3 a.m. Wednesday.

Brolin was held in custody on a misdemeanor public intoxication charge and released.


"This was a booking only to hold him until he sobered up," Lewis said. "We do not normally file any charges on persons for simple intoxication."

Police said they would only book someone on a more serious charge and request that the City Attorney's Office prosecute if that person became a "chronic drain on resources" or has multiple arrests, Lewis said.

"In this case," Lewis said, "no further action is being sought."

Brolin's profile on imdb.com said his "rugged features" and "natural charm" have worked for him.

The son of actor James Brolin, his star has risen recently. He's played roles as a policeman, a hunter, and the President of the United States.

In his most recent film, "Gangster Squad," he plays Sgt. John O'Mara on a Los Angeles Police Department unit that chases notorious mobster Mickey Cohen.

Report: Top parks officials kept $20M hidden

SACRAMENTO, Calif. (AP) ? Officials at the highest levels of the California Department of Parks and Recreation helped keep millions of dollars secret for more than a decade, the California attorney general's office said in a report released Friday.

The report said the "intentional non-disclosure" continued because employees feared the department's budget would be cut if lawmakers found out, and that they would be embarrassed about the years of covering it up.

"Throughout this period of intentional non-disclosure, some parks employees consistently requested, without success, that their superiors address the issue," Deputy Attorney General Thomas M. Patton wrote in the report.

Parks Director Ruth Coleman, who had been director since 2002, resigned and a senior parks official was fired last summer after $54 million was found hidden in two special funds as up to 70 parks were threatened with closure because of budget cuts.

The report said the actual amount intentionally hidden in the State Parks and Recreation Fund was $20 million, and the remaining $34 million discrepancy was due to differences in the timing of the fund reports to the state finance department and the controller's office. The amount of money kept hidden had grown as high as $29 million in 2003, the report said.

The parks fund generates about $100 million each year through visitor fees and rentals. The fund has become a more vital source for the department as lawmakers reduce general support in the face of budget deficits.

The state will review the findings and decide whether to forward materials to law enforcement for a possible criminal case, said Richard Stapler, spokesman for the California Natural Resources Agency, which oversees the parks department.

No employees were found to have stolen or wrongly spent any of the money, the report said, but senior officials made deliberate decisions not to report the additional funds to the state Department of Finance, which helps the governor establish the state's annual spending plan.

Because the state Legislature did not know about the money, which was generated from park fees and rentals, officials had no authority to spend it, making it "an essentially useless reserve," the report said.

Coleman has denied knowing about the hidden money. She was the only current or former employee who would not agree to be interviewed by the attorney general's office, the report said. The report is based upon interviews with 40 former and current employees.

The report said several senior officials "were all well aware of the discrepancy."

It said all indications were that Tom Domich, the department's assistant deputy director of administrative services from 1987 to 2004, likely made the initial decision to keep the money secret, but several successive staffers continued the effort.

"The facts show that former budget officer Becky Brown noticed the growing disparity as early as 1998," the report said. By late 2002, "the budget and accounting officers and their supervisor ... were all aware of the discrepancy. Thereafter, from 2002 to 2012, numerous individuals failed to take appropriate action to ensure the monies were revealed to the DOF."

The report said Coleman's second-in-command, Michael Harris, was the highest-ranking manager to order the continued secrecy of the funds. He was fired as chief deputy in July 2012 amid the parks scandal and now works at the California Department of Environmental Protection.

Parks officials' ability to keep the $20 million in special fund money secret was partly due to accounting discrepancies between the state Department of Finance and the controller's office, which rely on different calculations. A new law signed by Gov. Jerry Brown last year requires the departments to compare their annual reports detailing how much money is in the more than 500 special state funds.

At least two budget officials told investigators they reported the hidden money to Domich, but he "refuses to acknowledge these facts and unpersuasively denies all knowledge of the disparity and his role in the deception," the report said.

"Consequently, it also cannot be determined with certainty whether the matter was reported to Ruth Coleman, who became acting director in January 2002 and went on to serve as director until July 2012," the report said.

Messages left by The Associated Press at telephone listings for two people named Tom Domich and for Coleman were not immediately returned Friday. Coleman's attorney, Malcolm Segal of Sacramento, declined comment.

In her resignation letter, Coleman said she was "unaware of the excessive balance" in the parks fund but accepted responsibility for the problem.

Harris did not immediately respond to an email message on Friday.

Rob Boriskin, who was assistant deputy director of administrative services from February 2005 to April 2006, told investigators that he recalls bringing the matter to Coleman's attention, and she told him to focus on "the bigger overall pictures and not spending so much time doing spreadsheets."

Former deputy director of administrative services Manuel Lopez, who left the department in May after approving an unauthorized vacation buy-out scheme, told investigators he believed Coleman knew of the $20 million disparity.

Over five years, Lopez said, Coleman asked him each year why the parks fund failed to receive a financial performance award, and he would explain it was because there was extra money.

He told investigators the two even discussed asking finance officials for approval to spend it, "'so she knew that there was money available,'" the report states.

The report said claims that Coleman knew of the money were "unreliable."

Sandy Hook students prep for emotional return

MONROE, Conn.?Sandy Hook Elementary School teachers, students and parents are preparing for an emotional return to school on Thursday at a repurposed facility here, less than a month after a gunman killed 20 children and six adults?including principal Dawn Hochsprung?at their school in Newtown, Conn.

On Wednesday, a day before classes are set to resume,?students and parents are scheduled to attend an open house at Chalk Hill School, a former middle school that workers have prepared to house the Sandy Hook children. School officials say they have tried to completely re-create classrooms in an effort to make students as comfortable as possible.

Parents are being encouraged to attend school with their children on Thursday.

"I want to reassure you that we understand many parents may need to be near their children on their first day(s) of school and you will be welcome," interim principal Donna Page wrote in a letter to parents. "That being said, we encourage students to take the bus to school in order to help them return to familiar routines as soon as possible. Parents choosing to join their children may come to school after our 9:07 a.m. opening and will be welcome in the classroom or the auditorium throughout the day."

To "ensure a safe and secure environment," Page continued, "we ask that no more than one adult family member accompany his/her child."

Some of the therapy dogs that have blanketed Newtown in the wake of the shootings will also be present at the school to comfort the children. Ten golden retrievers from Chicago's Lutheran Church Charities, which were sent to Newtown to comfort survivors last month, traveled back to Newtown on New Year's Day to prepare for the school's reopening.

Other public schools in Newtown reopened within a week of the shootings, but Sandy Hook Elementary has remained closed since Dec. 14, when 20-year-old gunman Adam Lanza shot his way into the school and opened fire before turning a gun on himself. Lanza also killed his mother in their Newtown home before going on the rampage, one of the deadliest in U.S. history.

"I want parents and families enduring the loss of their precious children to know their loved ones are foremost in our hearts and minds as we move forward," Page also wrote. "We recognize your needs are paramount in our preparations and planning. Your strength and compassion has been and will continue to be an inspiration to me and countless others as we work to honor the memory of your precious children and our beloved staff."
